Can a house thats been moved qualify for a conventional or FHA mortgage?

I bought a house 13 YRS ago, this house had been went previous to me buying it. I recived a loan for this house. I am now selling the house and had a contract on it and was supposed to close today. Last week the couple that was supposed to buy the house backed out and said their mortgage lender told them that FHA nor Conventional would not loan on a house that has been went. We had a disclosure statement saying it had been went that the lender saw 3 weeks ago. The lender sent a letter to the real estate agent stating what I wrote above. What can be done legally to rectify this if anything?

HUD earnest money question?

Hi, we recently received our sales contract back, and are ready to go. We had to place ,000 in earnest money in the escrow of our real estate agent. During the walk through, she told us that she cuts a check back to us at closing, so we were plotting on using this money for some repairs and furniture. This is a HUD home, and HUD is paying for 00 in closing costs. Well, I got an email from her today, and she said that the title company will credit us back the earnest money at closing. What does that mean "credit back". Will it go towards the mortgage, or will they give us a check? I heard that it would normally go towards closing costs. Uuuugh, this HUD stuff is getting harder and harder every day to deal with….

Hud ratified sales contract?????

Hi. Our bid was accepted on a HUD home on 8/11. We sent all of our paperwork in before the 48 hours. On Monday, my real estate agent received a fax back from HUD, saying that she did not fully fill out the front page (grrrrr!). She fixed all of the errors and over-nighted it on Tuesday, so they should have received it Wednesday (8/20). All she had to do was fill in an address and have her supervisor sign something. So that should be it, right? I’m wondering how long it will be, now, before we really receive the sales contract back? Do they send it to my house, or do they send it to the Real Estate Agent’s office? I guess I feel like it isn’t my house until I really get the sales contract back from HUD. I know we are lucky, since I heard that sometimes if your paperwork isn’t right, that they may place the house back up to be bid on. We should have heard something by now, if they weren’t pleased with the paperwork, right? The website still lists it as being accepted. I need to stop worrying……..

Short Sale in Florida. Does Buyer need an attorney?

I am buying a house on small sale in Florida. There are 5 known liens place on the property, including unpaid taxes for the last year. I have a copy of HUD estimate approved by the seller’s lender. So I know all lien holders. I also can do the last minute search on the Internet right before the closing in order to avoid any surprises.

In this situation, do I need a real estate attorney to make sure all liens are satisfied and I get the property with the marketable title? Or closing title company can handle all this issues?

My real estate agent advises to hire an attorney for the flat fee of ,000. Will it be a waste of money in Florida?

I guess, my question is What value will a real estate attorney add to the small sale process?

I can search public records for new liens right before the close, make sure that they are satisfied at closing, and then check public records if my buy is properly recorded.

Also, what are the legal mechanisms available to protect me from the new liens?

Just closed on this home buy.

We hired an attorney and made the lender pay for it. Strongly recommend getting an attorney for the buyers.

Our attorney not only negotiated the fees but also make a lot of amendments to the documents. Saved us a lot of money. Hope this info is helpful for people dealing with small sales. Thanx All.

Closing costs question (In California)?

I need to revise this question because people apparently were not reading it thoroughly:

Is there any "closing costs help" program still active for buying a house in Ca? The stuff you can google appears to be non-existant anymore. Does anyone know of any actual existing program that helps people with closing costs? I have the down payment (FHA) but the closing cost part is killing me.

Please, I’m NOT looking for guesses or suggestions (I can guess fine myself), I’m looking for actual programs that still exist. Again, I’M NOT LOOKING FOR SUGGESTIONS on what to do. If I could borrow the money from a relative I wouldn’t be asking this in here. I already tried adding the closing costs to the offer but I can’t come in under the appraised value. I’ve already wasted money on appraisers and finished up getting screwed. So please, no "have you tried this…" answers. This is either a "yes, there is this program…" or "no, there is no program." Thank you

I have questioned my bank and real estate agent and they do not know of any program, hence my coming in here.
